UNCONTESTED DIVORCE: In Virginia, an uncontested or no-fault divorce
can be granted based upon the grounds of living separate and apart for
the applicable statutory period. In order to satisfy the necessary
elements to obtain a no-fault divorce, the parties must have lived
separate and apart without cohabitation or interruption for a period of
12 months or more. If the husband and wife have no minor children born
of or adopted by the marriage and have a signed separation agreement, a
no-fault divorce may be obtained after a separation period of 6 months.
No-fault divorces can be performed on a flat fee basis and can be
concluded in a short turnaround if the parties are in agreement.
SEPARATION AGREEMENTS: In Virginia, Separation Agreements, also known
as Stipulation an Property Settlement Agreements and Martial Settlement
Agreements, are contracts between the parties that resolve all of the
issues to be considered in a divorce, before the parties actually file
for divorce. Issues that can be governed by a PSA include, but are not
limited to: division of property, child support, spousal support, child
custody/visitation, division of pension/retirment plans, tax planning
andd insurance coverage. There are many benefits to having a separation
agreement. The parties agree to resolve all potential issues, the rights
of the parties are protected and the contract is enforceable in a court
of law. In addition to the security and stability benefits from an
Agreement, signing one will also reduce the waiting period from 12
months to 6 months if the parties have no minor children and are seeking
a no-fault divorce.
PREMARITAL AGREEMENTS: (Prenuptial Agreements) The term “pre-nup” evokes
images of older couples marrying who already have accumulated their
wealth, not two young people starting out. That image is quite outdated.
Today, many younger people, with or without assets, are obtaining
premarital agreements prior to marriage. No matter how romantic your
notions of marriage are, it simply makes good sense to determine your
legal rights and obligations upon the event of divorce. Before marriage
the future husband and wife can determine the rights and obligations of
either party concerning any property, spousal support, life insurance
benefits, wills, disposition of property upon divorce, and any other
rights or obligations that are not illegal and do not violate public
policy. Child support is NOT an issue that can be decided in a
premarital agreement. A premarital agreements should be signed well in
advance of the wedding and each party should have effective, legal
representation before signing.
